Women’s Public Union Erayim’s project entitled ‘The Introduction of a Combination of Traditional and Modern Approaches to Prevent Conflict in the South of Kyrgyzstan’ has been extended for another 2.5 years and has also expanded its scope of activities with new types of services, one of which is the provision of legal advice. Gulnara Tashieva, a legal adviser in Jalal-Abad province, reported that a number of legal and consulting works have been carried out. Here are some examples of her work so far.

On March 14, 2017, Janyl Abzhaparova, a resident of Zhany-Akman village in the Bazar-Korgon district, approached the legal adviser with the following question: she has a land plot with the area of 40 hundredths, for which she has a certificate. She bought this land plot in 1999. But another person is working illegally on this land. She sued him, but the court has yet to make a decision despite deliberating for many years. Gulnara wrote a letter to the administration of Akman village district regarding this issue, asking them to resolve it. A special commission was formed from the staff of the village administration. As a result, the commission measured the land plot and returned it to the rightful owner. Janyl has since planted clover and works on her own land.

On March 27, 2017, Turarbek Rakhmanaly uulu, a resident of Besh-Badam Street in Bazar-Korgon village, appealed to a lawyer about a house bought by his parents in 1997 in the village. However, this house was bought without any legal documents. Turarbek grew up in this house, as has his own family, but it never occurred to him during these years to register the house under his name. After the death of the former owner, who had sold Turarbek’s family this house, the situation became more complicated. Wherever they turned, no one could help them. He turned to the lawyer of WPU Erayim in Bazar-Korgon, his last hope. Having received legal advice from the lawyer, he began the first steps towards legalizing the house. He applied to the relevant authorities, collected receipts paid for utilities and testimony from neighbors. A commission was established from experts of Bazar-Korgon village which included the head of the Bazar-Korgon land administration department, A. Sultanaliev, the specialist of the same department, K. Ermatov, the land specialist of the Bazar-Korgon village district, M. Kalykov, and the head of the village, T. Abdanaev.

They visited the house, measured the area and on April 28, 2017 they drafted an act and handed it over to the appropriate body. On the basis of commission №01-17/18 of May 4, 2017, a decision was taken to legalize the residential building to Turarbek Rakhmanaly uulu in which he lives at Mal Bazar Street of Bazar-Korgon village district.

On April 3, 2017, Gafurzhan Ergashev of 12 Kyrgyz Street in Bazar-Korgon village asked the lawyer to help him with his problem. His daughter Mashkhura had divorced her husband after the birth of her second child. In March 2016, the Bazar-Korgon district court passed a decision on the recovery of maintenance for the child. But, the husband did not pay the alimony and his debt reached eighteen thousand soms. Talks were held with the father on this issue and explanatory work was carried out. As a result, he paid eighteen thousand soms and noted that he will continue to pay alimony for his children every month.

Also, a resident of Nasyrov Street in Bazar-Korgon village, a member of the Nasaatchy self-help group, Ainura Mamyrbaeva, approached the legal adviser with her problem. She divorced her husband, also a resident of the Bazar-Korgon village, Abdurashid Zhuraev. They have four children. The ex-husband is addicted to alcohol and does not work. In 2016, the Bazar-Korgon District Court ruled on the recovery of maintenance for the children, but he did not paid a single som. Ainura lives in the dormitory of the Joomart Bokonbaev boarding school with their four children. She brings up and feeds the children on her own and works in the school cafeteria. The legal consultant sent letters to the Bazar-Korgon village administration and the district administration. As a result, the district administration provided material assistance in the amount of three thousand soms, and the village administration promised to help her with the problem.

A resident of Jalal-Abad city, Baktygul Urkunbaeva, who lives at 46 Nagornaya Street in the Ch. Aitmatov district of the city, also asked the legal advisor for help. She had married a man living in Besh-Badam village of Bazar-Korgon district. On September 16, 2016, after receiving a civil passport, she moved to Jalal-Abad city. In order to register a new place of residence, she applied to the relevant body, but she was told that she had to withdraw from her former place of residence first. She with her husband went to the Bazar-Korgon village administration. There she was asked to go to the district registry office for acts of civil status. Thus, they were tortured by endless red tape. In the end, she gave up. At the time when the psychologist and the project legal advisor visited the region for advisory work, Baktygul asked the project specialists to help her in this matter. The legal advisor began to make every possible effort to resolve this issue. The legal advisor applied to the relevant parties and collected the necessary documents. As a result, Baktygul Urkunbaeva’s issue was resolved and she was finally able to register at her new place of residence.

In addition, Gulnara meets with the members of the self-help groups in her region and gives them legal advice. She usually deals with the social issues such as family proceedings, documentary issues, and migration issues.
